Description

The Naval Air Systems Command (NAVAIR), Patuxent River, MD, intends to negotiate and award a delivery order on a sole source basis under Basic Ordering Agreement N0001925G0003 with NORTHROP GRUMMAN SYSTEM CORPORATION (NGSC), 600 Hicks RD, Rolling Meadows IL 60008-1015 for the procurement of Software, Engineering, and the Logistics Support to integrate the AN/APR-39E(V)2 system. This system will function as the Electronic Warfare bus controller for Department of the Navy (DoN) aircraft. This contract is being pursued on a sole source basis under the statutory authority of 10 U.S.C. 3204 (a)(1) as implemented by Federal Acquisition Regulation (FAR) Overhaul 6.103-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency

Requirements.” NGSC is the sole designer, developer, manufacturer, and integrator of the APR-39 system. Consequently, NGSC is the only known source with the requisite technical data, specialized knowledge, and infrastructure capable of fulfilling this requirement without causing unacceptable delays or duplicating costs. Although a sole-source award is intended, other interested and capable companies may submit a "capability statement." The Government will review these submissions to determine whether a competitive procurement might be feasible. However, the final decision to compete the contract or not remains at the Government's discretion.
