FAR 5.101(a)(2)(ii) makes it clear it is not needed to solicit when oral solicitations are used. Based on how the GAO interpreted both provisions in Matter of Phoenix ENv't Design, Inc., B0422950 (Dec 10. 2024), it is indeed possible that oral solicitations could potentially be used in acquisitions where the IGE was between $20,000.00 and $350,000.00 as, they indicated that 5.101(a)(2)(ii) overrode 5.101's general rule requiring that the
