This requirement will include a base year and four option years. ERDC-CERL has determined that only one responsible source will satisfy agency
requirements and intends to award this acquisition in accordance with RFO FAR 12.102(a) to West Publishing Corporation (Westlaw) as the company is the only provider of the Enflex EDGE environmental regulatory database. West Publishing Corporation (Westlaw) is the sole producer/provider of the Enflex EDGE environmental regulatory database. ERDC-CERL has utilized Enflex for its regulatory research needs for over 28 years, with our internal updating process closely interwoven with the way Enflex updates the state environmental regulations. Enflex itself is based on the CELDS database, which was originally developed by DoD funded research, and also operates in a fashion based on how CERL does their regulatory updates. CERL researchers have looked for alternative sources of regulatory updates over the years but have yet to find any similar alternative or substitute. Also, there are certain regulatory updates that are only available through Westlaw. Westlaw’s online database includes contents such as full American legal reports and GAO legislative history. In addition, Westlaw has recently added features that are helpful to research needs. For example, the EDGE features allowing on-the-fly comparisons of previous versions of any statute or regulation throughout its history. EDGE also tracks requests for regulation changes that have been submitted by agencies nationwide and are under review. No other sources include all of this information in one consolidated database. This is not a request for proposal and in no way obligates the Government to award any contract. The associated North American System (NAICS) code is 513199, All Other Publishers, which has a size standard of 1,000 employees. This is not a small business set aside. Any interested party that believes they can fulfil this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government’s acquisition strategy.
