Description

The United States Air Force Test Center/Directorate of Contracting (AFTC/PZZG), located at 5 S. Wolfe Ave, Edwards AFB, CA, 93524 intends to issue a sole source, FFP contract to a large business, CHARTER COMMUNICATIONS OPERATING LLC AKA Spectrum, located at 12405 Powerscourt Dr Saint Louis, Missouri 63131-3673, for 40 Gb Internet connection to meet test mission needs. The contract will be executed by means of other than full and open competition, due to Spectrum being the only approved vendor to supply these services at Edwards AFB, CA. Justification, Statutory Authority: Per RFO 6.103 Other than full and open competition. (a) Agencies may contract without providing for full and open competition under authorities specified in this section (see 10 U.S.C. 3204 and 41 U.S.C. 3304). RFO 6.103-1 Only one responsible source and no other supplies or services will satisfy agency

requirements. The authority permitting the use of noncompetitive procedures is 10 U.S.C. 3204(a)(1) or 41 U.S.C. 3304(a)(1). In order to comply with RFO 5.101(c)(4)(vii), the reason for lack of competition is as follows: The AD CTF requires 40 Gb Internet connection to meet test mission needs. This Spectrum contract replaces current Internet service (Interim solution) where government furnished equipment is utilized. Spectrum provides Spectrum owned and managed equipment. Spectrum will be responsible for providing all equipment and its maintenance during the lifespan of this contract. Internet service will be provided to the following facilities: 3920A, 3920B, 156B, 156C/D, 156E, 156F, 156G, 310. This will be an options contract consisting of one base year + 4 option years. Previously there were 3 approved commercial Internet vendors. The security

requirements to allow commercial Internet revealed only Spectrum, AT&T, and Lumen were qualified to provide this service based on those

requirements. Recently those

requirements and approval process have been modified and only Spectrum has completed the necessary work to be approved. To allow more commercial Internet companies would require a massive collection of information from each vendor and approval from the Security Controls Assessor for every company. The duplication of costs would be approximately $7000 per vendor, for the security checks along with the cost of the vendors to lay thousands of feet of fiber. FAR 52.225-3, Buy American–Free Trade Agreements–Israeli Trade Act, FAR 52.225-5, Trade Agreements, and FAR 52.225-11, Buy American-Construction Materials under Trade Agreements, or FAR 52.225-23, Required Use of American Iron, Steel, and Manufactured Goods-Buy American Statute-Construction Materials under Trade Agreements do not apply to this acquisition.
