Description

: Defense Health Agency 8110 Gatehouse Road Fairfax, VA 22033 SUBJECT: Justification for Other than Full and Open Competition; Dental Chair Installation. This memorandum for record acts as the government official justification and approval for soliciting the requirement, A-DEC Dental Chair Installation, under other than full and open competition in accordance with (IAW) Federal Acquisition Regulation (FAR) 6.302-1(ii). The contents provided herein contain the required information mandated IAW FAR 6.303. 1.) Demonstration of Unique Qualifications (FAR 6.303-2(b)(5)) This requirement is a follow-on action in conjunction with the acquisition of 511 dental chairs and the following components: foot switches, 482 monitor mounts, monitor mounts handles, 532 pro delivery system, tray holder mount, self-contained water system 572L, Dental Light, 551 assistant’s instrumentation. In accordance with Federal Acquisition Regulation 6.302-1(a)(2)(ii) “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in – (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or (B) Unacceptable delays in fulfilling the agency’s

requirements.” Given that the dental chairs were originally acquired from A-DEC, their installation meets the criteria of a follow-on acquisition. Additionally, A-DEC provides the government with credit for the removal of the existing dental chairs and a 10-year warranty, leading to a substantial reduction in cost, fulfilling the

requirements of section (A). Furthermore, the current dental chairs do not meet the manufacturer safety standards, placing liability on 31 MDG, the United States Air Force (USAF), and the Defense Health Agency (DHA), requiring immediate corrective action, meeting the criteria stipulated FAR 6.302-1(a)(2)(ii)(B). 2.) Efforts to Obtain Competition (FAR 6.303-2(b)(6)) This requirement is being solicited as a sole source requirement under Federal Acquisition Regulation 6.302-1(a)(2)(ii) – Follow on acquisition. As such no efforts were made to obtain competition. However, the preceding contract action was solicited under full and open competition and recompete

requirements for dental chairs will be competed under full and open competition. 3.) Determination that anticipated costs will be fair and reasonable (FAR 6.303-2(b)(7)) The estimated cost of this contract was compared against contracts previously deemed fair and reasonable in similar scope and size on the government system FPDS-NG. The search concluded that this requirement and the estimated cost is well within the competitive range for contracts of similar scope and size. 4.) Market Research (FAR 6.303-2(b)(8)) Market research concluded that this requirement is commercial in nature and readily available on the commercial marketplace, providing confirmation that this requirement is not inherently governmental. However, this requirement was submitted under a valid sole source as such this requirement will be solicited under other than full and open competition and posted on the government point of entry SAM.Gov.
