Contracting Office (NCO) 6, on behalf of the Durham VA Medical Center intends to enter into a sole source procurement with Carl Zeiss Microscopy LLC, 1 North Broadway, White Plains, NY 10601 for Preventative Maintenance and Inspection on Zeiss Axio Scan Z1. The Precision Equipment Repair and Maintenance. The size standard is $34 million. The proposed contract action is to provide preventative maintenance, hardware/software support and repair service on Zeiss Axio Scan Z1 for a Base plus 2 Option years. The only company that can provide this service is Carl Zeiss Microscopy LLC. This procurement is intended to be awarded based on a sole-source requirement. The Government intends to solicit and negotiate with only one source under the authority of RFO 6.103-1 (b), using the procedures under RFO 12.102 (a), Restricting Competition. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government. If no written response is received within the closing date of this notice, a sole source award will be given to Carl Zeiss Microscopy LLC without any further notice. Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e., replacement parts), verified by an authorization letter or other documents from the OEM such that the OEM s warranty and service are provided and maintained by the OEM. The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of contract or, solely at the VA s discretion, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to the VA medical facility upon discovery of such items.
