Description

This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested. Purpose The National Institute of Standards and Technology (NIST) intend to negotiate a firm-fixed priced purchase order on a sole source basis with Magnet Forensics, LLC, located at 300 Colonial Center Pkwy Ste 130 Roswell, GA 30076. The purchase order will specifically procure GriffEye Analyze License and CS Operations Client software for a one-year base period with options for two additional years. Authority This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the

Contracting Officer (CO) to solicit from one source. The North American Industry System (NAICS) code for this acquisition is 513210 – Software Publishers with a small business size standard of $47.0 Million. The NIST National Construction Safety Team (NCST) utilizes a license of the forensic photo and video tagging software, Magnet Forensics/GriffEye CS Operations and client, which is being used for the investigation of partial collapse of the Champlain Towers South condominium building. NCST currently holds an annual license for the use of this software and is in need of renewal services to continue the investigation of a partial collapse, which took place at the Champlain Towers South Condominium building. Sole Source Determination The sole source determination is based on the following: GriffEye Analyze License and CS Operations Client software are a method of photographing and video tagging forensic evidence. NIST uses this software to support its investigation of the partial collapse which took place at the Champlain Towers South Condominium building. Continued access to this software is required for continuity of investigation activities for the remainder of the investigation. Use of another software would jeopardize clarity of evidence record keeping and create significant risks and delays in the investigation process. Magnet/GriffEye individually develops and distributes this software and has no authorized resellers. Use of a different software solution would result in the duplication of efforts since the formatting within Magnet/GriffEye system is not compatible with any other programing. More so, NIST would incur unacceptable costs for extending the investigation beyond its originally proposed completion date. This includes lost of public trust and additional cost for travel, labor, and opportunity cost that would otherwise be saved if determined to remain on the current software. Magnet/GriffEye is therefore the only capable source. Information for Interested Parties Interested parties that believe they could satisfy the

requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice. This notice of intent is not a solicitation. Any
