6/16/2026 See Special Notice Attachment 4/16/2026 All Interested Contractors – Due to the Revolutionary FAR Overhaul (RFO), Source Selection procedures are a quickly changing policy landscape. Based upon the FY26 NDAA, Commercial Solution Opening (CSO) use is expanded beyond “innovate” solutions to all commercial products. It is anticipated that this change will be codified into U.S. Code § 3458 on 6/30/2026. However, there is no set date regarding when the DoD regulations will reflect this change; therefore, the team plans to submit a Class Deviation for approval to deviate from the regulations as soon as the U.S. Code is updated. Approval of the Class Deviation cannot be guaranteed; however, again the team will attempt to obtain this approval. If successful, the draft RFP will be revised in order to align more with a CSO likely limiting proposal
requirements from what is currently required on the Draft RFP. Furthermore, if approved, a CSO would likely result in a FAR based contract with a clause set similar to the currently released Draft RFP. With that said, if the approval is obtained, the draft RFP will be revised accordingly as soon as possible after approval. 3/20/2026 Attachment added for vendor Q&A's.
